Sublet, Guest, Roommate or Apartment Use Information


Guests:

By way of definition, a guest is someone who stays in your apartment for a period of less than 30 days when you are in residence. If your guest doesn’t need access to your apartment when you are not in the apartment, there is no need to fill out a guest form. Simply allow them access when the doorman calls to announce them. In other cases, for example, if you are in residence, but at work during the day, and you want your guest to have access to your apartment, you will need to complete a Guest Access Form. This should be submitted to the Management Office 3 days prior to your guest’s arrival so that we can review the request, enter the data into our system and provide them with a Guest Access Card. Guest Access Forms are also in the Management Office. They are not available at the Doorman station nor can the Doormen accept the completed forms.

Apartment Use Request:

A person staying in your apartment when you are away is governed by your lease and NYC law. Such occupancy is considered a sublet even if the stay is just short term. Permission is needed by Waterside Management for this arrangement, which is reviewed on a case by case basis. Please do not pretend you are home if you will not be. Eventually, this will become obvious to Waterside personnel, either because of a lock out or some other equally frequent event. Circumventing apartment use rules by knowingly and fraudulently filling out a form in an untrue manner will have repercussions for you and your visitor. Please click for Apartment Use Request Form. In ALL instances, using apartment share websites such as Air BNB for short term rentals are violations of the Waterside lease and in most instances a violation of NYC law.

Sublet:

Permission is needed by Waterside Management for this arrangement. There are many time sensitive steps in applying for a sublet. It is strongly encouraged that you review Real Property Law § 226-b.
